     Legal services:

      When buying a property in Spain the procedure is different from that in the UK. So, briefly:-    

1 - find your property

2- agree the purchase price

3-    Reserve the property for your purchase by paying a holding deposit (normally 10%). This will be done by signing a private contract and the property will be withdrawn from the market for the duration of the private contract to completion

4-    For the new escritura (deeds) to be drawn up you’ll need a Spanish bank account and a Numero de Identificacion de Extranjero (NIE), which is basically an  identification number for “foreigners” with financial affairs in Spain. Copies of your passport will be required to facilitate this

5-    We recommend that you use the services of an abogado (solicitor) with local knowledge and experience to ensure all the necessary searches concerning, for example, claims or debts etc. against the property in order to ensure the purchasing of the property runs as smoothly as possible. There are few English speaking solicitors locally but we can recommend a first class Translation Service which will ensure you understand each step of the process

6-    The balance of the purchase price will be required for payment to the vendor on completion. This will be carried out at a Notario’s (public notary’s) office.

7-    When the new escritura is ready for you to sign you will need to settle the following extra purchase expenses: Notary fees; Registration fees; Property Transfer Tax. These vary from sale to sale depending upon i.e. declared purchase price, or how complicated the escritura changes have been etc. Budget for Approx 10% of the purchase price to cover these expenses.

8-     When signed, the new escritura will be sent to the Land Registry to be enscribed. You will be given a stamped copia simple (a notarised copy)

When in possession of your new home you will need to inform various organisations, including the Ayuntamiento (Town Hall) of the change of ownership. Water, Electric, Rates, Phone and Gas contracts will need changing/organising.
